Independent review into legal challenges against Nationally Significant Infrastructure Projects

An independent report from Lord Charles Banner KC reviewing the Legal Challenges to Nationally Significant Infrastructure Projects (NSIP) has been published.

In early 2024, the previous government appointed Lord Banner KC to lead an independent review into the causes of legal challenges brought against the NSIP regime and to explore the scope and options for improving existing processes. The report contains ten recommendations for government on how to reduce barriers to development and resolve challenges more effectively.

The report from Lord Banner KC can be found here. Alongside the publication of the review, the Ministry of Justice, has published a call for evidence seeking views on Lord Banner’s recommendations. It can be found here and closes on 30 December 2024.
